Warranty

Limited Warranty:
U.S. Energy Sciences, Inc. warrants to the original Purchaser/End-user that the U.S. Energy Sciences, Inc. fixture shall be free from defects in material and construction for a period of one (1) year from the date of purchase. The Warranty shall not apply to damage resulting from alteration, misuse, neglect, unauthorized repair, improper cleaning, fire, accident, abuse, negligence, or corrosive airborne agents such as strong chemicals, bases or acids. Furthermore, no warranty is made that the fixture is saleable or fit for any application or warranty not described herein. U.S. Energy Sciences, Inc. shall not be liable for any damages (incidental or consequential, or otherwise) arising from the product defects.

Limitation of Remedies:
Should the fluorescent fixture develop a condition or deterioration in contravention of this Warranty during the Warranty period, U.S. Energy Sciences, Inc.'s only obligation and Purchaser's exclusive remedy of the defective product, excluding installation, upon notification thereof and substantiation that the product has been stored, installed, maintained, transported, operated and serviced in accordance with U.S. Energy Sciences, Inc.'s written instructions and specifications.

Claims Procedure:
If Purchaser desires replacement under the Warranty, Purchaser shall make a written request/claim for such to U.S. Energy Sciences, Inc. within thirty (30) day of Purchaser's discovery of the condition requiring such replacement, and obtain a return authorization number. Upon receipt of the return authorization number, the defective Product shall be returned, freight prepaid except during the first thirty (30) day after original receipt, in which case shipping shall be on a freight collect basis, in the original shipping container or its equivalent, to the destination specified by U.S. Energy Sciences, Inc. The purchaser assumes risk of loss or damage in transit.
